These Terms of Service ("Terms") constitute a legally binding agreement between you ("User," "you," or "your") and AmpedTrade LLC ("AmpedTrade," "we," "us," or "our") governing your access to and use of our AI-powered trading code generation platform and services.

By accessing our website, creating an account, or using our services, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy.

If you do not agree to these Terms, you must not access or use our services.

Service Description

AmpedTrade provides an AI-powered conversational assistant specializing in algorithmic trading code generation. Our service transforms natural language descriptions into syntactically correct Pine Script code for TradingView indicators and trading strategies.

What AmpedTrade IS:

• A code development assistant for trading indicators and strategies
• A text-to-code converter specializing in Pine Script
• A workflow accelerator for trading algorithm development
• An educational tool for learning Pine Script syntax and best practices

What AmpedTrade IS NOT:

• An automated trading system or trade execution platform
• An investment advisor or financial advice provider
• A backtesting or strategy performance analysis tool
• A money management or fund administration service
• A brokerage or market data connection service

User Responsibilities and Acceptable Use

Code Validation

You are solely responsible for:

• Testing and validating all generated code before implementation
• Ensuring code compliance with your local regulations and exchange rules
• Understanding the functionality and risks of any trading strategy
• Implementing appropriate risk management measures

Prohibited Uses

You agree not to:

• Use the service for any illegal activities or purposes
• Attempt to reverse engineer, decompile, or extract our AI models
• Use generated code for market manipulation or fraudulent activities
• Distribute, resell, or commercialize our services without authorization
• Share your account credentials with third parties
• Exceed rate limits or attempt to overload our systems
• Use the service to generate content that violates intellectual property rights

Age Requirements

You must be at least 18 years old to use AmpedTrade services. By using our services, you represent and warrant that you are at least 18 years of age.

AI Service Limitations and Accuracy

Subscription and Payment Terms

Billing

Subscription fees are billed in advance on a monthly basis. All fees are non-refundable except as required by law or as explicitly stated in these Terms.

Credits and Usage

• Each subscription plan includes a specific number of monthly credits
• Credits reset at the beginning of each billing cycle
• Unused credits do not roll over unless specified in your plan (Agency plan only)
• Additional credits may be purchased separately

Cancellation

You may cancel your subscription at any time. Cancellation takes effect at the end of your current billing period. You will retain access to paid features until the end of your billing period.

Intellectual Property Rights

Your Code and Content

You retain all rights to the trading code and strategies generated through our service. You may use, modify, and distribute generated code according to your needs, subject to these Terms.

Our Platform and AI Models

The AmpedTrade platform, AI models, algorithms, and underlying technology remain our exclusive intellectual property. You may not copy, modify, or create derivative works of our proprietary technology.

Data Training (Free Users)

For Free Trial users, conversations and generated code may be used to improve our AI models. Professional and Agency subscribers have enhanced privacy protections where their data is not used for model training.

Data Privacy and Security

We are committed to protecting your privacy and securing your data. Our data practices are detailed in our Privacy Policy, which is incorporated by reference into these Terms.

Professional and Agency Privacy

• Professional and Agency subscribers receive enhanced privacy protections
• Your conversations and code are not used to train our AI models
• Data is encrypted and isolated with additional security measures
• You may request deletion of your data at any time

Service Availability and Support

Uptime and Availability

We strive to maintain high service availability but cannot guarantee uninterrupted access. We may temporarily suspend or restrict access for maintenance, updates, or security reasons.

Support Levels

• Free Trial: Community support and documentation
• Professional: Email support with standard response times
• Agency: Priority support with guaranteed response times (SLA)

Limitation of Liability and Disclaimers

Limitation of Damages

To the maximum extent permitted by law, AmpedTrade shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or trading losses, regardless of the theory of liability.

Termination

Either party may terminate this agreement at any time. We may suspend or terminate your access immediately for violation of these Terms, illegal activity, or risk to our systems or other users.

Upon termination, your access to the service will cease, but these Terms will continue to apply to any prior use of the service.

Governing Law and Dispute Resolution

These Terms are governed by and construed in accordance with the laws of Wyoming, United States, without regard to conflict of law principles.

Any disputes arising under these Terms will be resolved through binding arbitration in accordance with the rules of the American Arbitration Association.

Changes to Terms

We reserve the right to modify these Terms at any time. We will notify users of material changes via email or platform notification at least 30 days before the changes take effect.

Continued use of our services after changes become effective constitutes acceptance of the modified Terms.
